法治政府建設實施綱要(2021-2025年)
法(fa)治(zhi)(zhi)政府(fu)建設(she)是全面依(yi)法(fa)治(zhi)(zhi)國的重點任務(wu)和主體工程,是推(tui)進(jin)(jin)國家治(zhi)(zhi)理體系和治(zhi)(zhi)理能力現代化的重要支撐。為在新(xin)發展階段持(chi)續深入推(tui)進(jin)(jin)依(yi)法(fa)行政,全面建設(she)法(fa)治(zhi)(zhi)政府(fu),根據(ju)當前法(fa)治(zhi)(zhi)政府(fu)建設(she)實(shi)際,制定本綱要。
一、深入學習貫徹習近平法治思想,努力(li)實現法治政府建設全面突破(po)
黨的(de)十八大以來,特別是《法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)實(shi)(shi)(shi)施綱要(yao)(2015-2020年(nian))》貫(guan)徹落實(shi)(shi)(shi)5年(nian)來,各(ge)地(di)區各(ge)部門(men)多(duo)措并舉、改革(ge)創新(xin),法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)取得重(zhong)大進(jin)(jin)展。黨對(dui)法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)的(de)領導不斷加(jia)強(qiang),責任(ren)督察(cha)和(he)示范創建(jian)活(huo)動(dong)深入實(shi)(shi)(shi)施,法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)推(tui)(tui)(tui)進(jin)(jin)機制(zhi)基本形(xing)成;“放管服”改革(ge)縱深推(tui)(tui)(tui)進(jin)(jin),營商環境大幅(fu)優化;依(yi)法行(xing)政(zheng)(zheng)(zheng)制(zhi)度體(ti)(ti)系(xi)日(ri)益健全(quan),重(zhong)大行(xing)政(zheng)(zheng)(zheng)決策(ce)程(cheng)序制(zhi)度初步建(jian)立(li),行(xing)政(zheng)(zheng)(zheng)決策(ce)公(gong)信力持續提升;行(xing)政(zheng)(zheng)(zheng)執法體(ti)(ti)制(zhi)機制(zhi)改革(ge)大力推(tui)(tui)(tui)進(jin)(jin),嚴格規范公(gong)正文明執法水平普遍(bian)提高(gao)(gao);行(xing)政(zheng)(zheng)(zheng)權(quan)力制(zhi)約和(he)監督全(quan)面加(jia)強(qiang),違(wei)法行(xing)政(zheng)(zheng)(zheng)行(xing)為(wei)能夠被及時糾(jiu)正查處(chu);社會(hui)(hui)矛盾糾(jiu)紛依(yi)法及時有效化解,行(xing)政(zheng)(zheng)(zheng)爭議預(yu)防化解機制(zhi)更加(jia)完善;各(ge)級(ji)公(gong)務員法治(zhi)(zhi)(zhi)(zhi)意識顯(xian)著(zhu)增(zeng)強(qiang),依(yi)法行(xing)政(zheng)(zheng)(zheng)能力明顯(xian)提高(gao)(gao)。當前,我國已經開啟全(quan)面建(jian)設(she)(she)(she)社會(hui)(hui)主義現(xian)代(dai)化國家(jia)、向第二個百年(nian)奮斗目標進(jin)(jin)軍的(de)新(xin)征程(cheng),統籌中華民族偉大復興戰略全(quan)局(ju)和(he)世界百年(nian)未有之大變局(ju),推(tui)(tui)(tui)進(jin)(jin)國家(jia)治(zhi)(zhi)(zhi)(zhi)理(li)體(ti)(ti)系(xi)和(he)治(zhi)(zhi)(zhi)(zhi)理(li)能力現(xian)代(dai)化,適應人民日(ri)益增(zeng)長的(de)美好生活(huo)需要(yao),都對(dui)法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)提出了新(xin)的(de)更高(gao)(gao)要(yao)求,必須立(li)足(zu)全(quan)局(ju)、著(zhu)眼長遠、補齊(qi)短板、開拓進(jin)(jin)取,推(tui)(tui)(tui)動(dong)新(xin)時代(dai)法治(zhi)(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府建(jian)設(she)(she)(she)再上新(xin)臺階。
(一)指(zhi)導思(si)(si)想(xiang)(xiang)。高(gao)舉(ju)中(zhong)(zhong)國(guo)特色社會(hui)主(zhu)義偉(wei)大旗幟,堅持以馬克思(si)(si)列寧主(zhu)義、毛澤(ze)東思(si)(si)想(xiang)(xiang)、鄧(deng)小平(ping)理論、“三個(ge)代表(biao)”重要思(si)(si)想(xiang)(xiang)、科學發展觀、習近平(ping)新(xin)時代中(zhong)(zhong)國(guo)特色社會(hui)主(zhu)義思(si)(si)想(xiang)(xiang)為(wei)指(zhi)導,全(quan)(quan)(quan)面貫徹(che)黨(dang)的十(shi)九大和(he)十(shi)九屆二中(zhong)(zhong)、三中(zhong)(zhong)、四(si)中(zhong)(zhong)、五中(zhong)(zhong)全(quan)(quan)(quan)會(hui)精神,全(quan)(quan)(quan)面貫徹(che)習近平(ping)法(fa)(fa)治(zhi)(zhi)思(si)(si)想(xiang)(xiang),增強“四(si)個(ge)意(yi)識”、堅定“四(si)個(ge)自信(xin)”、做(zuo)到“兩個(ge)維(wei)護”,把法(fa)(fa)治(zhi)(zhi)政(zheng)府建(jian)設(she)(she)放在黨(dang)和(he)國(guo)家事業發展全(quan)(quan)(quan)局中(zhong)(zhong)統籌謀(mou)劃,加快(kuai)構建(jian)職責(ze)明確、依法(fa)(fa)行政(zheng)的政(zheng)府治(zhi)(zhi)理體系(xi),全(quan)(quan)(quan)面建(jian)設(she)(she)職能科學、權責(ze)法(fa)(fa)定、執法(fa)(fa)嚴(yan)明、公開公正、智能高(gao)效、廉潔(jie)誠(cheng)信(xin)、人民滿意(yi)的法(fa)(fa)治(zhi)(zhi)政(zheng)府,為(wei)全(quan)(quan)(quan)面建(jian)設(she)(she)社會(hui)主(zhu)義現代化國(guo)家、實現中(zhong)(zhong)華民族(zu)偉(wei)大復興(xing)的中(zhong)(zhong)國(guo)夢提(ti)供有力(li)法(fa)(fa)治(zhi)(zhi)保(bao)障。
(二(er))主要(yao)原則。堅(jian)(jian)持(chi)黨的(de)全面領導(dao),確(que)保法治(zhi)政(zheng)(zheng)(zheng)府(fu)建(jian)設正確(que)方向;堅(jian)(jian)持(chi)以(yi)人(ren)民為中心,一切行政(zheng)(zheng)(zheng)機(ji)關(guan)必(bi)須為人(ren)民服務、對人(ren)民負(fu)責(ze)、受人(ren)民監督;堅(jian)(jian)持(chi)問題(ti)導(dao)向,用法治(zhi)給(gei)行政(zheng)(zheng)(zheng)權力(li)定規矩(ju)、劃界限,切實(shi)解(jie)決制約(yue)法治(zhi)政(zheng)(zheng)(zheng)府(fu)建(jian)設的(de)突(tu)出問題(ti);堅(jian)(jian)持(chi)改革創(chuang)新(xin),積極探(tan)索(suo)具有中國特色的(de)法治(zhi)政(zheng)(zheng)(zheng)府(fu)建(jian)設模(mo)式和路徑;堅(jian)(jian)持(chi)統籌推進(jin),強化法治(zhi)政(zheng)(zheng)(zheng)府(fu)建(jian)設的(de)整(zheng)體推動、協同發展。
(三)總體(ti)目(mu)標。到2025年,政(zheng)府(fu)行為全(quan)面納入法(fa)治(zhi)軌道(dao),職(zhi)責(ze)明(ming)確(que)、依法(fa)行政(zheng)的政(zheng)府(fu)治(zhi)理體(ti)系(xi)日益健(jian)全(quan),行政(zheng)執法(fa)體(ti)制機制基(ji)本(ben)完善,行政(zheng)執法(fa)質量和效能大幅提(ti)升,突發事件應對(dui)能力顯著增強,各(ge)地區各(ge)層級法(fa)治(zhi)政(zheng)府(fu)建設協調并進,更多地區實現率(lv)先突破(po),為到2035年基(ji)本(ben)建成法(fa)治(zhi)國家(jia)、法(fa)治(zhi)政(zheng)府(fu)、法(fa)治(zhi)社會奠定堅實基(ji)礎。
二、健全(quan)政(zheng)府機構職能體(ti)系,推(tui)動更好(hao)發(fa)揮政(zheng)府作(zuo)用
堅持(chi)法定職責必須(xu)為、法無授權(quan)(quan)不可為,著力實現政府職能深(shen)刻轉變,把該管(guan)的事務管(guan)好、管(guan)到位(wei),基本形成邊界清(qing)晰、分(fen)工合理、權(quan)(quan)責一致(zhi)、運行高效、法治保障(zhang)的政府機構(gou)職能體系。
(四)推進(jin)政(zheng)府(fu)(fu)機構職(zhi)能(neng)優(you)化(hua)協(xie)(xie)同高(gao)效。堅持優(you)化(hua)政(zheng)府(fu)(fu)組織結(jie)構與促進(jin)政(zheng)府(fu)(fu)職(zhi)能(neng)轉變、理(li)(li)順(shun)部門職(zhi)責關(guan)系統籌結(jie)合,使(shi)機構設置更(geng)加(jia)科學(xue)、職(zhi)能(neng)更(geng)加(jia)優(you)化(hua)、權責更(geng)加(jia)協(xie)(xie)同。完(wan)善經(jing)濟調(diao)節(jie)、市場(chang)監管、社(she)會管理(li)(li)、公共服務(wu)、生態環境保(bao)護(hu)等職(zhi)能(neng),厘(li)清政(zheng)府(fu)(fu)和(he)(he)市場(chang)、政(zheng)府(fu)(fu)和(he)(he)社(she)會關(guan)系,推動有效市場(chang)和(he)(he)有為(wei)政(zheng)府(fu)(fu)更(geng)好結(jie)合。強化(hua)制(zhi)(zhi)定實施(shi)發(fa)展戰略、規劃、政(zheng)策(ce)、標(biao)準等職(zhi)能(neng),更(geng)加(jia)注重運(yun)用法律(lv)和(he)(he)制(zhi)(zhi)度(du)遏(e)制(zhi)(zhi)不當干預微觀經(jing)濟活動的行(xing)為(wei)。構建簡約高(gao)效的基層(ceng)管理(li)(li)體制(zhi)(zhi),實行(xing)扁平化(hua)和(he)(he)網格化(hua)管理(li)(li)。推進(jin)編制(zhi)(zhi)資源向(xiang)基層(ceng)傾斜,鼓勵、支持從上(shang)往下跨層(ceng)級調(diao)劑使(shi)用行(xing)政(zheng)和(he)(he)事(shi)業編制(zhi)(zhi)。
全面(mian)實行(xing)政(zheng)府權(quan)責清(qing)單制度,推(tui)動(dong)各級政(zheng)府高效(xiao)履(lv)職盡責。2022年(nian)上(shang)半年(nian)編制完(wan)成國務院部門權(quan)責清(qing)單,建(jian)立公開(kai)、動(dong)態調整、考核評估、銜接規(gui)范等配套機(ji)制和辦法(fa)。調整完(wan)善地方各級政(zheng)府部門權(quan)責清(qing)單,加強標準化建(jian)設,實現同一事(shi)項的規(gui)范統一。嚴(yan)格執(zhi)行(xing)市場準入(ru)負面(mian)清(qing)單,普(pu)遍落實“非禁(jin)即入(ru)”。
(五)深入推(tui)進(jin)“放(fang)管服(fu)”改(gai)革。分級分類(lei)推(tui)進(jin)行(xing)(xing)(xing)(xing)政審(shen)(shen)批(pi)(pi)制(zhi)度改(gai)革。依托(tuo)全(quan)國一(yi)(yi)體化(hua)政務(wu)服(fu)務(wu)平臺等渠道,全(quan)面推(tui)行(xing)(xing)(xing)(xing)審(shen)(shen)批(pi)(pi)服(fu)務(wu)“馬(ma)上辦、網上辦、就(jiu)近辦、一(yi)(yi)次辦、自助辦”。堅決(jue)防(fang)止以備案、登記(ji)、行(xing)(xing)(xing)(xing)政確認(ren)、征求意見等方(fang)式變相(xiang)設(she)置行(xing)(xing)(xing)(xing)政許可事(shi)(shi)項(xiang)。推(tui)行(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)政審(shen)(shen)批(pi)(pi)告(gao)知承諾制(zhi)。大力歸并減(jian)少各類(lei)資質資格許可事(shi)(shi)項(xiang),降低準(zhun)入門檻。有序推(tui)進(jin)“證(zheng)(zheng)照分離”改(gai)革全(quan)覆(fu)蓋,將更多涉企經(jing)營許可事(shi)(shi)項(xiang)納入改(gai)革。積極(ji)推(tui)進(jin)“一(yi)(yi)業一(yi)(yi)證(zheng)(zheng)”改(gai)革,探索實現“一(yi)(yi)證(zheng)(zheng)準(zhun)營”、跨地互(hu)認(ren)通用。深化(hua)投(tou)資審(shen)(shen)批(pi)(pi)制(zhi)度改(gai)革,推(tui)進(jin)投(tou)資領域行(xing)(xing)(xing)(xing)政執法監督(du),全(quan)面改(gai)善(shan)投(tou)資環境。全(quan)面落實證(zheng)(zheng)明事(shi)(shi)項(xiang)告(gao)知承諾制(zhi),新設(she)證(zheng)(zheng)明事(shi)(shi)項(xiang)必須有法律法規或(huo)者(zhe)國務(wu)院決(jue)定依據。
推動(dong)政府(fu)管(guan)理(li)依法進(jin)行(xing)(xing),把(ba)更多(duo)行(xing)(xing)政資源從事前審批轉到(dao)事中事后監(jian)(jian)(jian)管(guan)上來。健全(quan)以“雙隨機(ji)、一(yi)公開”監(jian)(jian)(jian)管(guan)和(he)“互(hu)聯網+監(jian)(jian)(jian)管(guan)”為基(ji)本(ben)手段(duan)、以重點監(jian)(jian)(jian)管(guan)為補充、以信用監(jian)(jian)(jian)管(guan)為基(ji)礎的新(xin)型監(jian)(jian)(jian)管(guan)機(ji)制,推進(jin)線上線下一(yi)體化監(jian)(jian)(jian)管(guan),完善與創新(xin)創造相(xiang)適應(ying)的包(bao)容審慎監(jian)(jian)(jian)管(guan)方(fang)式。根據不同(tong)領域特點和(he)風險程度(du)確定監(jian)(jian)(jian)管(guan)內(nei)容、方(fang)式和(he)頻(pin)次(ci),提高監(jian)(jian)(jian)管(guan)精準(zhun)化水平。分領域制定全(quan)國統(tong)一(yi)、簡明易行(xing)(xing)的監(jian)(jian)(jian)管(guan)規(gui)則和(he)標準(zhun),做到(dao)標準(zhun)公開、規(gui)則公平、預期(qi)合理(li)、各負其責。
加(jia)快建設服(fu)(fu)務(wu)(wu)型(xing)政府,提(ti)(ti)高(gao)政務(wu)(wu)服(fu)(fu)務(wu)(wu)效能(neng)(neng)。全面提(ti)(ti)升政務(wu)(wu)服(fu)(fu)務(wu)(wu)水平,完(wan)善首問負責、一(yi)(yi)次告知、一(yi)(yi)窗受理(li)、自助辦理(li)等制度。加(jia)快推(tui)進政務(wu)(wu)服(fu)(fu)務(wu)(wu)“跨(kua)省(sheng)通(tong)辦”,到2021年年底前基本實(shi)(shi)現(xian)高(gao)頻(pin)事項(xiang)“跨(kua)省(sheng)通(tong)辦”。大力推(tui)行“一(yi)(yi)件事一(yi)(yi)次辦”,提(ti)(ti)供更多套餐式(shi)、主題式(shi)集成服(fu)(fu)務(wu)(wu)。推(tui)進線上(shang)線下深度融合(he),增(zeng)強全國(guo)一(yi)(yi)體(ti)化(hua)政務(wu)(wu)服(fu)(fu)務(wu)(wu)平臺(tai)服(fu)(fu)務(wu)(wu)能(neng)(neng)力,優化(hua)整(zheng)合(he)提(ti)(ti)升各級政務(wu)(wu)大廳“一(yi)(yi)站式(shi)”功(gong)能(neng)(neng),全面實(shi)(shi)現(xian)政務(wu)(wu)服(fu)(fu)務(wu)(wu)事項(xiang)全城通(tong)辦、就近能(neng)(neng)辦、異地可辦。堅(jian)持傳統服(fu)(fu)務(wu)(wu)與智能(neng)(neng)創新相結(jie)合(he),充分保障老年人(ren)基本服(fu)(fu)務(wu)(wu)需(xu)要。
(六)持續優化(hua)法(fa)(fa)治化(hua)營(ying)商(shang)環境。緊(jin)緊(jin)圍(wei)繞貫(guan)徹新(xin)發展理念(nian)、構建新(xin)發展格局,打造(zao)穩定公(gong)平透明、可預期的法(fa)(fa)治化(hua)營(ying)商(shang)環境。深入實施《優化(hua)營(ying)商(shang)環境條(tiao)例》。及(ji)時總結各地優化(hua)營(ying)商(shang)環境可復制(zhi)(zhi)(zhi)(zhi)可推(tui)廣的經(jing)驗做法(fa)(fa),適時上升為(wei)法(fa)(fa)律(lv)法(fa)(fa)規(gui)制(zhi)(zhi)(zhi)(zhi)度。依法(fa)(fa)平等保護各種所有制(zhi)(zhi)(zhi)(zhi)企(qi)業產權和自(zi)主經(jing)營(ying)權,切實防止濫用行政(zheng)權力(li)排除、限制(zhi)(zhi)(zhi)(zhi)競(jing)(jing)爭(zheng)(zheng)行為(wei)。健全(quan)外商(shang)投資準入前國民待遇加負面(mian)清單管(guan)理制(zhi)(zhi)(zhi)(zhi)度,推(tui)動(dong)(dong)規(gui)則、規(gui)制(zhi)(zhi)(zhi)(zhi)、管(guan)理、標準等制(zhi)(zhi)(zhi)(zhi)度型(xing)開放(fang)。加強政(zheng)企(qi)溝通,在制(zhi)(zhi)(zhi)(zhi)定修改(gai)行政(zheng)法(fa)(fa)規(gui)、規(gui)章、行政(zheng)規(gui)范性文件過程中充分聽取企(qi)業和行業協會商(shang)會意(yi)見(jian)。加強和改(gai)進反壟斷與反不(bu)正當競(jing)(jing)爭(zheng)(zheng)執法(fa)(fa)。強化(hua)公(gong)平競(jing)(jing)爭(zheng)(zheng)審查(cha)制(zhi)(zhi)(zhi)(zhi)度剛性約束,及(ji)時清理廢除妨礙統一(yi)市場和公(gong)平競(jing)(jing)爭(zheng)(zheng)的各種規(gui)定和做法(fa)(fa),推(tui)動(dong)(dong)形成統一(yi)開放(fang)、競(jing)(jing)爭(zheng)(zheng)有序、制(zhi)(zhi)(zhi)(zhi)度完備、治理完善的高標準市場體系。
三、健全依法行政(zheng)制度體系,加快推進政(zheng)府治(zhi)理規范化程序化法治(zhi)化
堅持科學立(li)(li)法(fa)(fa)、民主立(li)(li)法(fa)(fa)、依法(fa)(fa)立(li)(li)法(fa)(fa),著力實現政府立(li)(li)法(fa)(fa)質(zhi)量和(he)效率并重并進,增強(qiang)針對性(xing)、及時性(xing)、系(xi)統性(xing)、可操作性(xing),努力使政府治理各方面制度更加(jia)健全、更加(jia)完善。
(七(qi))加強重(zhong)要(yao)(yao)(yao)領域(yu)立(li)法(fa)。積極(ji)推進國(guo)家安全(quan)、科技創(chuang)新、公共(gong)衛(wei)生(sheng)(sheng)、文(wen)化(hua)教育、民族宗教、生(sheng)(sheng)物安全(quan)、生(sheng)(sheng)態(tai)文(wen)明(ming)、防范風險、反壟斷、涉外法(fa)治等重(zhong)要(yao)(yao)(yao)領域(yu)立(li)法(fa),健全(quan)國(guo)家治理急需的法(fa)律制度、滿足人(ren)(ren)民日(ri)益(yi)增長的美好生(sheng)(sheng)活需要(yao)(yao)(yao)必備的法(fa)律制度。制定(ding)修改(gai)傳染病防治法(fa)、突發(fa)公共(gong)衛(wei)生(sheng)(sheng)事件應對法(fa)、國(guo)境衛(wei)生(sheng)(sheng)檢疫法(fa)等法(fa)律制度。及時跟進研(yan)究數字(zi)經(jing)濟(ji)、互聯(lian)網金融(rong)、人(ren)(ren)工智能、大(da)數據、云(yun)計算(suan)等相關法(fa)律制度,抓(zhua)緊補齊(qi)短板,以良法(fa)善治保障新業態(tai)新模式(shi)健康(kang)發(fa)展。
加(jia)強(qiang)規范(fan)共同行(xing)政行(xing)為立法(fa)(fa),推(tui)進機構、職能、權限、程序(xu)、責任(ren)法(fa)(fa)定化。修改(gai)國務院組(zu)織法(fa)(fa)、地方各(ge)級人(ren)民代(dai)表大會和地方各(ge)級人(ren)民政府(fu)組(zu)織法(fa)(fa)。修改(gai)行(xing)政復議法(fa)(fa)、行(xing)政許可法(fa)(fa),完善行(xing)政程序(xu)法(fa)(fa)律制度(du)。研(yan)究制定行(xing)政備案條(tiao)例(li)、行(xing)政執法(fa)(fa)監(jian)督條(tiao)例(li)。

四、健全行政(zheng)決(jue)策制度體系,不斷提(ti)升行政(zheng)決(jue)策公(gong)信力(li)和執行力(li)
堅持科學決(jue)(jue)(jue)策(ce)(ce)、民(min)主決(jue)(jue)(jue)策(ce)(ce)、依法決(jue)(jue)(jue)策(ce)(ce),著(zhu)力實(shi)現(xian)行政決(jue)(jue)(jue)策(ce)(ce)程序規定嚴格落實(shi)、決(jue)(jue)(jue)策(ce)(ce)質量和效率顯著(zhu)提高,切實(shi)避免因決(jue)(jue)(jue)策(ce)(ce)失誤(wu)產生矛盾糾紛、引發(fa)社會風險、造成重大(da)損失。
(十)強化依(yi)法決(jue)策意識。各級行政(zheng)機關負(fu)責人要(yao)牢(lao)固樹立依(yi)法決(jue)策意識,嚴格遵(zun)循法定權(quan)限和程序作(zuo)出決(jue)策,確保(bao)決(jue)策內(nei)容符(fu)合法律法規規定。行政(zheng)機關主(zhu)要(yao)負(fu)責人作(zuo)出重大決(jue)策前(qian),應(ying)當聽取(qu)(qu)合法性審查機構的意見,注重聽取(qu)(qu)法律顧(gu)問、公職律師或(huo)者有關專(zhuan)(zhuan)家的意見。把(ba)是否(fou)遵(zun)守(shou)決(jue)策程序制度、做到(dao)依(yi)法決(jue)策作(zuo)為對政(zheng)府部門(men)黨組(黨委)開展巡視巡察和對行政(zheng)機關主(zhu)要(yao)負(fu)責人開展考核督察、經濟責任審計的重要(yao)內(nei)容,防(fang)止個人專(zhuan)(zhuan)斷、搞“一言堂”。

(十七)完(wan)善(shan)突(tu)發(fa)(fa)事(shi)(shi)件應(ying)(ying)對制(zhi)(zhi)(zhi)度。修改(gai)突(tu)發(fa)(fa)事(shi)(shi)件應(ying)(ying)對法(fa)(fa),系統梳理(li)和修改(gai)應(ying)(ying)急(ji)(ji)管理(li)相關法(fa)(fa)律法(fa)(fa)規,提(ti)高(gao)突(tu)發(fa)(fa)事(shi)(shi)件應(ying)(ying)對法(fa)(fa)治化(hua)規范化(hua)水平。健全國家(jia)應(ying)(ying)急(ji)(ji)預案體系,完(wan)善(shan)國家(jia)突(tu)發(fa)(fa)公共(gong)事(shi)(shi)件總體和專(zhuan)項應(ying)(ying)急(ji)(ji)預案,以及(ji)與(yu)之相銜接配套的(de)各級各類突(tu)發(fa)(fa)事(shi)(shi)件應(ying)(ying)急(ji)(ji)預案。加強突(tu)發(fa)(fa)事(shi)(shi)件監測預警(jing)、信(xin)息(xi)報(bao)告、應(ying)(ying)急(ji)(ji)響應(ying)(ying)、恢復(fu)重建、調(diao)查評估等(deng)機(ji)制(zhi)(zhi)(zhi)建設。健全突(tu)發(fa)(fa)事(shi)(shi)件應(ying)(ying)對征收(shou)、征用(yong)、救助、補償制(zhi)(zhi)(zhi)度,規范相關審批(pi)、實施程序和救濟途徑。完(wan)善(shan)特大城(cheng)市風險治理(li)機(ji)制(zhi)(zhi)(zhi),增強風險管控能力。健全規范應(ying)(ying)急(ji)(ji)處(chu)置收(shou)集、使(shi)用(yong)個(ge)人信(xin)息(xi)機(ji)制(zhi)(zhi)(zhi)制(zhi)(zhi)(zhi)度,切實保護(hu)公民個(ge)人信(xin)息(xi)。加快推進突(tu)發(fa)(fa)事(shi)(shi)件行(xing)政(zheng)(zheng)手段應(ying)(ying)用(yong)的(de)制(zhi)(zhi)(zhi)度化(hua)規范化(hua),規范行(xing)政(zheng)(zheng)權力邊(bian)界。
(十八)提高突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)依法(fa)(fa)(fa)(fa)處(chu)置能力。增強(qiang)(qiang)風險(xian)防范意識(shi),強(qiang)(qiang)化各(ge)地區各(ge)部門防范化解本地區本領域(yu)重大風險(xian)責(ze)任。推(tui)進應(ying)(ying)急(ji)管理綜合行政執法(fa)(fa)(fa)(fa)改革,強(qiang)(qiang)化執法(fa)(fa)(fa)(fa)能力建設。強(qiang)(qiang)化突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)依法(fa)(fa)(fa)(fa)分級(ji)分類(lei)施策,增強(qiang)(qiang)應(ying)(ying)急(ji)處(chu)置的(de)針對性(xing)實(shi)效性(xing)。按照平戰結合原則,完(wan)善(shan)各(ge)類(lei)突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)應(ying)(ying)急(ji)響應(ying)(ying)處(chu)置程序和協調聯(lian)動(dong)機(ji)制。定期開展應(ying)(ying)急(ji)演練,注重提升依法(fa)(fa)(fa)(fa)預防突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)、先期處(chu)置和快速(su)反應(ying)(ying)能力。加強(qiang)(qiang)突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)信(xin)息公(gong)(gong)開和危機(ji)溝通,完(wan)善(shan)公(gong)(gong)共輿情應(ying)(ying)對機(ji)制。依法(fa)(fa)(fa)(fa)嚴厲打擊利(li)用(yong)突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)哄(hong)抬物(wu)價、囤(dun)積(ji)居(ju)奇、造(zao)謠滋(zi)事(shi)(shi)、制假售(shou)假等(deng)擾亂社會秩序行為。加強(qiang)(qiang)突(tu)(tu)發(fa)事(shi)(shi)件(jian)(jian)應(ying)(ying)急(ji)處(chu)置法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規教育培訓,增強(qiang)(qiang)應(ying)(ying)急(ji)處(chu)置法(fa)(fa)(fa)(fa)治意識(shi)。
(十九(jiu))引導、規范基層組織和社會力量(liang)(liang)參(can)(can)與突(tu)發事(shi)(shi)件應(ying)對(dui)。完善(shan)鄉(xiang)鎮(zhen)(街(jie)道)、村(社區(qu))應(ying)急處(chu)置組織體系,推動村(社區(qu))依法參(can)(can)與預防(fang)、應(ying)對(dui)突(tu)發事(shi)(shi)件。明確社會組織、慈善(shan)組織、社會工作者、志愿者等參(can)(can)與突(tu)發事(shi)(shi)件應(ying)對(dui)的法律地位及其權利(li)義(yi)務,完善(shan)激勵保障措施。健(jian)全社會應(ying)急力量(liang)(liang)備(bei)案登記、調用補償、保險保障等方面(mian)制(zhi)度。
七、健全社(she)會矛盾糾(jiu)紛(fen)行政預(yu)防(fang)調處化解(jie)體(ti)系,不斷促進社(she)會公(gong)平(ping)正(zheng)義
堅(jian)持將(jiang)矛(mao)盾糾紛化解在(zai)萌(meng)芽(ya)狀態、化解在(zai)基層,著力(li)實現人民群眾(zhong)權(quan)益受(shou)到公(gong)平對待、尊嚴獲(huo)得應有尊重,推動完善信訪、調(diao)解、仲裁、行(xing)政(zheng)裁決、行(xing)政(zheng)復議(yi)、訴訟等(deng)社會矛(mao)盾糾紛多元預防調(diao)處化解綜合機制(zhi)。
(二十)加(jia)強(qiang)行政(zheng)調(diao)解(jie)工作。依法(fa)加(jia)強(qiang)消(xiao)費者權益(yi)保護、交通(tong)損害賠償(chang)、治安(an)管理、環境污染、社會保障、房屋土地征收、知識(shi)產權等方(fang)面的行政(zheng)調(diao)解(jie),及時妥善推進矛盾(dun)糾紛化解(jie)。各職能部(bu)門要規(gui)范行政(zheng)調(diao)解(jie)范圍和程序,組(zu)織做(zuo)好教育培訓,提升行政(zheng)調(diao)解(jie)工作水(shui)平。堅持“三調(diao)”聯動,推進行政(zheng)調(diao)解(jie)與人民調(diao)解(jie)、司法(fa)調(diao)解(jie)有效(xiao)銜(xian)接(jie)。
(二十一)有序推(tui)(tui)進行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)工作。發(fa)揮(hui)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)化(hua)解(jie)民事糾紛的(de)“分流閥”作用,建(jian)立(li)體系健全、渠(qu)道暢通、公(gong)正(zheng)便(bian)捷、裁(cai)(cai)訴銜接的(de)裁(cai)(cai)決(jue)機制。推(tui)(tui)行(xing)(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)權利告(gao)知制度(du),規(gui)范(fan)(fan)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)程序,推(tui)(tui)動有關行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)機關切實履(lv)行(xing)(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)職責(ze)。全面梳理行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)事項,明確行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)適用范(fan)(fan)圍(wei),穩妥(tuo)推(tui)(tui)進行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)改革試點。強化(hua)案(an)例指導和業務(wu)培訓,提升(sheng)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)能(neng)力。研(yan)究推(tui)(tui)進行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁(cai)(cai)決(jue)法律制度(du)建(jian)設。
(二十二)發(fa)揮行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)化(hua)解行(xing)政(zheng)(zheng)(zheng)爭議(yi)(yi)(yi)主渠道作用(yong)。全(quan)面深化(hua)行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)體(ti)制(zhi)(zhi)改革,整(zheng)合地方行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)職責,按照事編匹配、優化(hua)節約、按需調劑的原則,合理調配編制(zhi)(zhi)資(zi)源(yuan),2022年(nian)年(nian)底前基本(ben)形成公正(zheng)權威、統(tong)一高(gao)效的行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)體(ti)制(zhi)(zhi)。全(quan)面推進行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)規范化(hua)、專業(ye)化(hua)、信(xin)息化(hua)建設,不斷提高(gao)辦(ban)案質量和效率(lv)。健全(quan)優化(hua)行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)審理機(ji)制(zhi)(zhi)。縣級以上各級政(zheng)(zheng)(zheng)府建立行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)委員會,為重(zhong)大、疑難、復(fu)雜的案件提供(gong)咨詢意見(jian)。建立行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)決定(ding)書(shu)以及(ji)行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)意見(jian)書(shu)、建議(yi)(yi)(yi)書(shu)執行(xing)監(jian)督(du)機(ji)制(zhi)(zhi),實(shi)現個(ge)案監(jian)督(du)糾錯與倒逼依法(fa)行(xing)政(zheng)(zheng)(zheng)的有機(ji)結合。全(quan)面落實(shi)行(xing)政(zheng)(zheng)(zheng)復(fu)議(yi)(yi)(yi)決定(ding)書(shu)網上公開制(zhi)(zhi)度(du)。
(二十三(san))加強(qiang)和(he)規范(fan)行(xing)(xing)(xing)(xing)政(zheng)應(ying)訴(su)(su)工(gong)作。認真執行(xing)(xing)(xing)(xing)行(xing)(xing)(xing)(xing)政(zheng)機(ji)關負責(ze)人出(chu)庭應(ying)訴(su)(su)制度。健(jian)全行(xing)(xing)(xing)(xing)政(zheng)爭議(yi)實質性化解(jie)機(ji)制,推動(dong)訴(su)(su)源治理(li)。支(zhi)持法(fa)院依法(fa)受理(li)和(he)審理(li)行(xing)(xing)(xing)(xing)政(zheng)案件,切實履(lv)行(xing)(xing)(xing)(xing)生(sheng)效裁判。支(zhi)持檢察院開展行(xing)(xing)(xing)(xing)政(zheng)訴(su)(su)訟監(jian)督工(gong)作和(he)行(xing)(xing)(xing)(xing)政(zheng)公益訴(su)(su)訟,積(ji)極主動(dong)履(lv)行(xing)(xing)(xing)(xing)職責(ze)或者(zhe)糾正違法(fa)行(xing)(xing)(xing)(xing)為(wei)。認真做(zuo)好司法(fa)建議(yi)、檢察建議(yi)落實和(he)反(fan)饋工(gong)作。
八、健全行政權力制約和監督體系,促(cu)進行政權力規范透明運行

(二(er)十六)加強(qiang)(qiang)對行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)制約和監督。加強(qiang)(qiang)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)監督機(ji)(ji)(ji)制和能力建(jian)設,充分(fen)發揮行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)監督統籌協(xie)調(diao)(diao)、規(gui)(gui)范(fan)保障(zhang)、督促指導作(zuo)(zuo)用(yong),2024年年底前基(ji)本建(jian)成省市(shi)縣(xian)鄉全覆蓋的比較完(wan)善的行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)協(xie)調(diao)(diao)監督工(gong)作(zuo)(zuo)體系。全面落實(shi)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)責(ze)(ze)任(ren)(ren),嚴(yan)格(ge)按照(zhao)權責(ze)(ze)事(shi)項清單分(fen)解(jie)執(zhi)(zhi)法(fa)(fa)(fa)職權、確(que)定執(zhi)(zhi)法(fa)(fa)(fa)責(ze)(ze)任(ren)(ren)。加強(qiang)(qiang)和完(wan)善行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)案卷管理(li)和評(ping)查(cha)、行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)機(ji)(ji)(ji)關(guan)處理(li)投訴舉報、行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)考核(he)評(ping)議(yi)等制度建(jian)設。大力整治重點領(ling)域(yu)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)不(bu)(bu)作(zuo)(zuo)為亂作(zuo)(zuo)為、執(zhi)(zhi)法(fa)(fa)(fa)不(bu)(bu)嚴(yan)格(ge)不(bu)(bu)規(gui)(gui)范(fan)不(bu)(bu)文(wen)明(ming)(ming)不(bu)(bu)透(tou)明(ming)(ming)等突出(chu)(chu)問題,圍(wei)繞中(zhong)心工(gong)作(zuo)(zuo)部署開展(zhan)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)監督專(zhuan)項行(xing)(xing)動。嚴(yan)禁(jin)下(xia)達(da)或者變(bian)(bian)相(xiang)下(xia)達(da)罰沒指標,嚴(yan)禁(jin)將罰沒收入同(tong)作(zuo)(zuo)出(chu)(chu)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)處罰的行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)機(ji)(ji)(ji)關(guan)及(ji)其工(gong)作(zuo)(zuo)人(ren)員(yuan)的考核(he)、考評(ping)直(zhi)接或者變(bian)(bian)相(xiang)掛鉤。建(jian)立并實(shi)施行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)執(zhi)(zhi)法(fa)(fa)(fa)監督員(yuan)制度。

(二十八)加快推進政務誠(cheng)信(xin)建(jian)設。健全(quan)(quan)(quan)政府守信(xin)踐諾(nuo)機制(zhi)。建(jian)立政務誠(cheng)信(xin)監測治理機制(zhi),建(jian)立健全(quan)(quan)(quan)政務失(shi)(shi)信(xin)記(ji)錄(lu)制(zhi)度(du),將違約毀約、拖欠賬款(kuan)、拒不履行(xing)司法裁判等失(shi)(shi)信(xin)信(xin)息納入全(quan)(quan)(quan)國(guo)信(xin)用(yong)信(xin)息共享平臺并向(xiang)社(she)會公開。建(jian)立健全(quan)(quan)(quan)政府失(shi)(shi)信(xin)責任追(zhui)究制(zhi)度(du),加大失(shi)(shi)信(xin)懲戒力度(du),重(zhong)點治理債務融資(zi)(zi)、政府采購、招(zhao)標(biao)投標(biao)、招(zhao)商(shang)引資(zi)(zi)等領域(yu)的政府失(shi)(shi)信(xin)行(xing)為。

堅持運用互聯(lian)網、大數(shu)據、人工智能等(deng)技(ji)術手(shou)段促進依法行政,著力實現政府治理信息(xi)化(hua)(hua)(hua)與法治化(hua)(hua)(hua)深度(du)融合,優化(hua)(hua)(hua)革新政府治理流(liu)程和方式,大力提升法治政府建設數(shu)字化(hua)(hua)(hua)水平(ping)。

(三十一)深入推進(jin)“互(hu)聯網+”監管(guan)(guan)執(zhi)(zhi)法(fa)(fa)。加(jia)強國(guo)家“互(hu)聯網+監管(guan)(guan)”系統建設,2022年年底(di)前實(shi)現(xian)各方面監管(guan)(guan)平(ping)臺(tai)數據(ju)的(de)(de)聯通匯聚(ju)。積極推進(jin)智慧執(zhi)(zhi)法(fa)(fa),加(jia)強信(xin)息(xi)化技術、裝備的(de)(de)配(pei)置(zhi)和應用。推行(xing)(xing)(xing)行(xing)(xing)(xing)政執(zhi)(zhi)法(fa)(fa)APP掌(zhang)上(shang)執(zhi)(zhi)法(fa)(fa)。探(tan)索推行(xing)(xing)(xing)以遠程(cheng)監管(guan)(guan)、移動監管(guan)(guan)、預警防控為特征(zheng)的(de)(de)非現(xian)場監管(guan)(guan),解決人少事多的(de)(de)難題。加(jia)快(kuai)建設全(quan)國(guo)行(xing)(xing)(xing)政執(zhi)(zhi)法(fa)(fa)綜(zong)合管(guan)(guan)理(li)監督信(xin)息(xi)系統,將執(zhi)(zhi)法(fa)(fa)基礎數據(ju)、執(zhi)(zhi)法(fa)(fa)程(cheng)序(xu)流轉(zhuan)、執(zhi)(zhi)法(fa)(fa)信(xin)息(xi)公開(kai)等匯聚(ju)一體,建立全(quan)國(guo)行(xing)(xing)(xing)政執(zhi)(zhi)法(fa)(fa)數據(ju)庫。
十、加強黨(dang)的領導,完善法治政府建設推(tui)進機制
黨(dang)的(de)(de)(de)領導是全面依法治國、建設法治政府的(de)(de)(de)根本保證,必須堅持黨(dang)總(zong)攬全局、協調各方,發(fa)揮(hui)各級黨(dang)委的(de)(de)(de)領導作(zuo)用,把法治政府建設擺到(dao)工作(zuo)全局更(geng)加突出(chu)的(de)(de)(de)位置。
(三十二(er))加強黨(dang)(dang)對法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)的領(ling)導(dao)。各級黨(dang)(dang)委(wei)和政(zheng)(zheng)(zheng)府(fu)(fu)要(yao)(yao)(yao)(yao)(yao)深入學(xue)習(xi)領(ling)會習(xi)近(jin)平法(fa)治(zhi)(zhi)(zhi)思(si)想,把(ba)習(xi)近(jin)平法(fa)治(zhi)(zhi)(zhi)思(si)想貫徹落實(shi)(shi)到(dao)法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)全過程(cheng)和各方面。各級黨(dang)(dang)委(wei)要(yao)(yao)(yao)(yao)(yao)切(qie)實(shi)(shi)履(lv)行推進法(fa)治(zhi)(zhi)(zhi)建(jian)設(she)(she)(she)領(ling)導(dao)職責(ze),安排聽(ting)取(qu)有關(guan)工(gong)作(zuo)匯報,及時研究解決(jue)影響法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)重大問(wen)題。各級政(zheng)(zheng)(zheng)府(fu)(fu)要(yao)(yao)(yao)(yao)(yao)在黨(dang)(dang)委(wei)統一領(ling)導(dao)下,履(lv)行法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)主(zhu)體(ti)責(ze)任,謀(mou)劃落實(shi)(shi)好法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)各項任務,主(zhu)動向(xiang)黨(dang)(dang)委(wei)報告(gao)法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)中(zhong)的重大問(wen)題。各級政(zheng)(zheng)(zheng)府(fu)(fu)及其部(bu)門主(zhu)要(yao)(yao)(yao)(yao)(yao)負責(ze)人(ren)要(yao)(yao)(yao)(yao)(yao)切(qie)實(shi)(shi)履(lv)行推進本地區(qu)(qu)本部(bu)門法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)第一責(ze)任人(ren)職責(ze),作(zuo)為重要(yao)(yao)(yao)(yao)(yao)工(gong)作(zuo)定期部(bu)署推進、抓實(shi)(shi)抓好。各地區(qu)(qu)黨(dang)(dang)委(wei)法(fa)治(zhi)(zhi)(zhi)建(jian)設(she)(she)(she)議事協調機(ji)構及其辦事機(ji)構要(yao)(yao)(yao)(yao)(yao)加強法(fa)治(zhi)(zhi)(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建(jian)設(she)(she)(she)的協調督促推動。
(三十三)完善法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)推進(jin)機制。深入推進(jin)法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)督察工作(zuo),2025年(nian)前實(shi)現(xian)對(dui)地方各級政府(fu)(fu)(fu)督察全覆蓋。扎實(shi)做好法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)示范(fan)(fan)創建(jian)(jian)(jian)(jian)活動(dong),以創建(jian)(jian)(jian)(jian)促提升(sheng)(sheng)、以示范(fan)(fan)帶發(fa)展(zhan),不(bu)斷激發(fa)法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)的內(nei)生動(dong)力(li)。嚴格執行(xing)法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)年(nian)度報(bao)告制度,按時向社會(hui)公開。建(jian)(jian)(jian)(jian)立健(jian)全法(fa)(fa)(fa)治(zhi)(zhi)政府(fu)(fu)(fu)建(jian)(jian)(jian)(jian)設(she)指標(biao)體系,強化指標(biao)引領。加(jia)大考核力(li)度,提升(sheng)(sheng)考核權重(zhong),將(jiang)依法(fa)(fa)(fa)行(xing)政情況作(zuo)為對(dui)地方政府(fu)(fu)(fu)、政府(fu)(fu)(fu)部門及其(qi)領導干(gan)部綜合(he)績效考核的重(zhong)要內(nei)容。
(三十四(si))全面(mian)加(jia)(jia)強依法(fa)(fa)(fa)行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)能(neng)(neng)力建設。推動(dong)行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機(ji)(ji)關(guan)負(fu)責(ze)人(ren)(ren)帶頭遵守(shou)執(zhi)行(xing)憲法(fa)(fa)(fa)法(fa)(fa)(fa)律,建立(li)行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)機(ji)(ji)關(guan)工作(zuo)人(ren)(ren)員(yuan)應知應會法(fa)(fa)(fa)律法(fa)(fa)(fa)規清單。堅持把民法(fa)(fa)(fa)典(dian)作(zuo)為行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)決策、行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)管理、行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)監(jian)督的(de)重要(yao)標尺,不得違背法(fa)(fa)(fa)律法(fa)(fa)(fa)規隨(sui)意作(zuo)出減損公(gong)民、法(fa)(fa)(fa)人(ren)(ren)和其(qi)他組織(zhi)合法(fa)(fa)(fa)權益或增加(jia)(jia)其(qi)義務的(de)決定(ding)。健全領導干部(bu)學(xue)法(fa)(fa)(fa)用法(fa)(fa)(fa)機(ji)(ji)制(zhi),國務院各(ge)部(bu)門根據職(zhi)(zhi)能(neng)(neng)開展(zhan)本(ben)部(bu)門本(ben)系統法(fa)(fa)(fa)治專(zhuan)題培訓(xun),縣級(ji)以上地方各(ge)級(ji)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)負(fu)責(ze)本(ben)地區領導干部(bu)法(fa)(fa)(fa)治專(zhuan)題培訓(xun),地方各(ge)級(ji)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)領導班子每(mei)年(nian)應當舉辦兩期(qi)以上法(fa)(fa)(fa)治專(zhuan)題講座。市縣政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)承擔(dan)行(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)執(zhi)法(fa)(fa)(fa)職(zhi)(zhi)能(neng)(neng)的(de)部(bu)門負(fu)責(ze)人(ren)(ren)任期(qi)內至少(shao)接受一次法(fa)(fa)(fa)治專(zhuan)題脫產培訓(xun)。加(jia)(jia)強各(ge)部(bu)門和市縣政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)法(fa)(fa)(fa)治機(ji)(ji)構(gou)建設,優化基(ji)層司法(fa)(fa)(fa)所職(zhi)(zhi)能(neng)(neng)定(ding)位(wei),保障人(ren)(ren)員(yuan)力量、經費(fei)等與其(qi)職(zhi)(zhi)責(ze)任務相適應。把法(fa)(fa)(fa)治教育納(na)入各(ge)級(ji)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)工作(zuo)人(ren)(ren)員(yuan)初(chu)任培訓(xun)、任職(zhi)(zhi)培訓(xun)的(de)必訓(xun)內容(rong)。對在法(fa)(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)建設中作(zuo)出突出貢獻(xian)的(de)單位(wei)和個人(ren)(ren),按規定(ding)給(gei)予表(biao)彰獎勵。
加(jia)強(qiang)(qiang)政(zheng)(zheng)府立法(fa)(fa)(fa)能力(li)建設(she),有計劃組織開展專題培(pei)訓,做好(hao)政(zheng)(zheng)府立法(fa)(fa)(fa)人(ren)才培(pei)養和儲備(bei)。加(jia)強(qiang)(qiang)行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)隊伍專業化(hua)職業化(hua)建設(she),在完成政(zheng)(zheng)治理(li)論教育(yu)和黨性教育(yu)學時的(de)基礎上,確保(bao)每(mei)人(ren)每(mei)年接受不少(shao)于(yu)60學時的(de)業務知識和法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規培(pei)訓。加(jia)強(qiang)(qiang)行(xing)(xing)政(zheng)(zheng)復議(yi)工作隊伍專業化(hua)職業化(hua)建設(she),完善管理(li)辦法(fa)(fa)(fa)。加(jia)強(qiang)(qiang)行(xing)(xing)政(zheng)(zheng)復議(yi)能力(li)建設(she),制定行(xing)(xing)政(zheng)(zheng)復議(yi)執(zhi)業規范。加(jia)強(qiang)(qiang)法(fa)(fa)(fa)律(lv)顧問(wen)和公(gong)職律(lv)師(shi)隊伍建設(she),提(ti)升法(fa)(fa)(fa)律(lv)顧問(wen)和公(gong)職律(lv)師(shi)參(can)與重大決策的(de)能力(li)水平。加(jia)強(qiang)(qiang)行(xing)(xing)政(zheng)(zheng)裁決工作隊伍建設(she)。
(三(san)十五(wu))加強(qiang)(qiang)(qiang)理論研(yan)究(jiu)(jiu)和輿論宣傳(chuan)(chuan)。加強(qiang)(qiang)(qiang)中(zhong)國(guo)特(te)色社會主義法治政(zheng)府(fu)理論研(yan)究(jiu)(jiu)。鼓勵、推(tui)動高(gao)等(deng)法學院校(xiao)成立(li)(li)法治政(zheng)府(fu)建(jian)設(she)高(gao)端智(zhi)庫(ku)和研(yan)究(jiu)(jiu)教(jiao)育基地。建(jian)立(li)(li)法治政(zheng)府(fu)建(jian)設(she)評估(gu)專(zhuan)家(jia)庫(ku),提升評估(gu)專(zhuan)業化(hua)水平(ping)。加大(da)法治政(zheng)府(fu)建(jian)設(she)成就經驗宣傳(chuan)(chuan)力度(du),傳(chuan)(chuan)播(bo)中(zhong)國(guo)政(zheng)府(fu)法治建(jian)設(she)的(de)時代強(qiang)(qiang)(qiang)音。
各(ge)地區(qu)各(ge)部門要(yao)(yao)全面準確貫徹本綱要(yao)(yao)精神和要(yao)(yao)求(qiu),壓實(shi)(shi)責任、狠抓(zhua)落實(shi)(shi),力戒(jie)形式主義(yi)、官僚(liao)主義(yi)。中央(yang)依法治(zhi)國辦要(yao)(yao)抓(zhua)好督促(cu)落實(shi)(shi),確保綱要(yao)(yao)各(ge)項任務措(cuo)施落到實(shi)(shi)處。
